Before this goes live

Placeholder — must be reviewed by counsel before launch. This is a reasonable starting draft written to be consistent with the offer as described elsewhere on this site. It is not legal advice and it has not been reviewed by an attorney. Replace the entity name, governing law, and dispute provisions with real ones.

These Terms govern your use of ownerbuiltsoftware.com and any services provided by [LEGAL ENTITY NAME] (“OwnerBuilt,” “we,” “us”). By using this site or engaging our services you agree to them.

1. The proposal call

The proposal produced on an initial consultation is provided free of charge and without obligation. It reflects our good-faith estimate of scope and price based on the information you provide during the call. It is not a binding quote and is valid for 30 days. It is yours to keep and use as you see fit.

2. The 48-hour build engagement

Upon payment of the $2,900 deposit and written confirmation of scope, we will deliver a working application within 48 hours of kickoff. The working app is hosted on infrastructure we control and accessed through credentials we issue. Title to and ownership of the working app source code remains with us during this phase.

3. Refunds

The deposit is refundable in full if requested within 7 calendar days of delivery, for any reason, without justification. Our full Refund Policy is incorporated into these Terms by reference. Where these Terms and the published Refund Policy conflict, the published Refund Policy governs.

4. The full build

Full build engagements are governed by a separate written agreement setting out scope, milestones, payment schedule and acceptance criteria. Payment is typically 50% at build start and 50% on delivery, with the deposit credited against the first payment. Ownership of the delivered source code and transfer of hosting occurs upon receipt of final payment.

5. Your responsibilities

You are responsible for the accuracy of the information you provide, for having the right to provide any data you give us, and for obtaining any consents required for that data. You agree not to use the software we provide for unlawful purposes.

6. Confidentiality

We treat what you tell us about your business as confidential and will not disclose it except to personnel and subcontractors working on your engagement. We will sign your NDA on request. We use subcontractors and partner development firms, who are bound by equivalent confidentiality obligations.

7. Warranties and limitations

The 48-hour build is delivered as a working demonstration of core functionality and is not warranted as production-ready, secure at scale, or compliant with any regulatory framework unless expressly agreed in writing. Except as expressly stated, services are provided “as is.” Our aggregate liability under any engagement is limited to the fees you have paid us for that engagement.

8. Changes

We may update these Terms. Material changes will be reflected in the “last updated” date above. The version in effect when you engaged us governs that engagement.

9. Governing law and contact

These Terms are governed by the laws of [STATE], without regard to conflict of law principles. Questions: hello@ownerbuiltsoftware.com.
